2. These terms

These Terms of Service apply when you access our website or purchase products from us.

By placing an order, you agree to these terms together with our Privacy Policy, Shipping Policy and Return and Refund Policy.

Nothing in these terms limits any statutory consumer rights that cannot legally be excluded.

3. Products

Our merchandise is produced on demand by third-party production partners. Products may therefore be manufactured and shipped from different locations.

We make reasonable efforts to display product descriptions, dimensions, colours and images accurately. Screen settings, production methods and natural variations in materials may result in minor differences.

These minor variations do not affect your rights where a product is faulty, materially misdescribed or does not match what you ordered.

4. Orders

Submitting an order is an offer to purchase the selected products. An order is accepted when we confirm that it has been accepted or submitted for production.

We may cancel or decline an order where:

• A product is unavailable

• Payment cannot be authorised

• Pricing or product information contains an obvious error

• We reasonably suspect fraud, misuse or unlawful activity

• We cannot deliver to the supplied address

If we cancel an order after payment, we will refund the affected amount.

5. Prices and payment

Prices are displayed in the currency selected on the website. Applicable taxes and delivery charges will be displayed before an order is completed where they can be calculated in advance.

International orders may be subject to customs duties, import taxes or handling charges. Where these are not collected during checkout, the recipient may be responsible for paying them.

Payment must be authorised before production begins.

6. Production and delivery

Products require a production period before dispatch. Current estimated fulfilment and delivery information is set out in our Shipping Policy and may also be displayed during checkout.

Delivery dates are estimates unless we expressly agree to a guaranteed date. We will contact you if we become aware of a significant delay.

7. Changes and cancellations

Production can begin shortly after an order is submitted. Contact us immediately if you need to request a change or cancellation.

We cannot guarantee that a production order can be stopped or changed. This does not affect any statutory cancellation rights applying to eligible products.

8. Returns and refunds

Returns, cancellations, exchanges and refunds are governed by our Return and Refund Policy.

Personalised products may be excluded from change-of-mind cancellation rights where permitted by law. This does not remove your rights when a product is faulty, damaged, incorrectly produced or materially different from its description.

9. Intellectual property

Unless otherwise stated, all artwork, photographs, logos, product designs, text and other content on this website belong to Phil Hampson, Gumshoe Music, Hampson Studios or their respective licensors.

You may not reproduce, distribute, modify, manufacture from, sell or commercially exploit our content without prior written permission.

Purchasing a product does not transfer ownership of its design or any associated intellectual-property rights.

10. Acceptable use

You must not use this website:

• For unlawful or fraudulent purposes

• To interfere with its operation or security

• To distribute malicious software

• To collect information about other users without permission

• To infringe another person’s rights

We may restrict access where these terms are breached.

11. Third-party services

Our store uses third-party providers for hosting, payments, production, shipping and analytics. Those providers may process information as described in our Privacy Policy.

Links to external websites are provided for convenience. We are not responsible for their content or availability.

12. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Subject to those exceptions, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses resulting from a consumer purchase.

13. Events outside our control

We are not responsible for delays caused by events reasonably outside our control, including carrier disruption, severe weather, customs delays, industrial action or disruption affecting a production partner.

We will take reasonable steps to minimise the effects of such events and honour any rights available under applicable law.

Our collection and use of personal information are described in our Privacy Policy and cookie settings.

15. Changes to these terms

We may update these terms periodically. The terms applying to an order are those published when the order was placed, unless a legal change must apply differently.

16. Governing law

These terms are governed by the laws of England and Wales.

Consumers living elsewhere retain any mandatory protections provided by the laws of their country. Nothing in this section prevents a consumer from bringing proceedings in a court available under applicable consumer law.
